Bueno solo han pasado 2 semanas… casi nada, hasta que me han enviado un documento que se supone que tengo que firmar o negociar el contenido. Desde luego es para mear y no echar gota lo que me envian para firmar, con lo que tendré que seguir charlando con ellos hasta que lleguemos a un acuerdo… o no.
A continuación os dejo el texto que me han enviado. Está en inglés, pero mas abajo haré un pequeño resumen comentando los aspectos mas… llamativos del documento:
Image Space Incorporated RELEASE FORM When executed by you, the following release will ensure that Image Space Incorporated may use the models, textures, sounds, files, service marks, logos, copyrights, or other materials provided by you to Image Space Incorporated, in connection with its interactive software products and for its promotional purposes.
I, the undersigned, hereby grant to Image Space Incorporated, its parent, subsidiaries, affiliates, successors, licensees and assigns (“ISI”) the worldwide, perpetual right, with the right to grant others, but not the obligation to use, reproduce, distribute, broadcast, transmit and display publicly or otherwise, the (the “Materials”) delivered to ISI in and in connection with any and all interactive software products developed by or on behalf of ISI on any media or platform now known or hereafter invented (the “Products”).
ISI may, at its option, use the Materials in connection with the Products developed by or for ISI, as well as in advertising, promotion, news and entertainment releases, and any other method of publicity regarding ISI or any and all of its Products, alone and/or coupled with other materials. The Materials may be exhibited, reproduced and otherwise exploited by ISI by any and all methods and means, whether now known or hereafter devised, in any and all media, throughout the world without limitation. Any copyright and trademarks remain the property of their respective owners.
I expressly release ISI, its agents, successors, licensees and assigns, from any and all claims, demands and liabilities by reason of ISI’s use of the Materials.
Image Space Incorporated will provide examples of how the Materials will be used. I will then have thirty (30) days to revoke all rights if I feel the Materials are not being represented accurately and in good faith.
I warrant that I am fully authorized to grant the rights granted in this Agreement. I understand that ISI will rely on the contents of this Agreement in developing the Products and in using the Materials.
Basicamente en resumen es… tu danos todos los derechos del circuito de por vida por nada a cambio… Es un buen trato , ¿no? De todas formas voy a poner los puntos un poco mas claros, aunque la intencion general del documento esta clara.
Al principio de todo dice que al firmar este documento cedo a ISI y a todas las compañias que ellos quieran, todos los derechos a nivel mundial del material que les entregue (el circuito).
El segundo párrafo dice que podrán usar el circuito para lo que quieran en el momento que quieran y de la manera que ellos quieran, y si le sumamos el siguiente párrafo, significaría que libero a ISI de cualquier obligacion, responsabilidad, cargo, etc que pudieran generar/incumplir ELLOS por el uso del circuito, vamos que el marrón me lo comería yo.
Lo único que me ofrecen es enseñarme 30 días antes (o después mas bien en este caso) de usar el software que les cedo y revocar los derechos que tienen si creo que se va a usar de manera indebida. Desde luego es un contrato cojonudo ¿verdad?
Y lo peor de todo es que ni se menciona cuanto me van a pagar por usar mi circuito, que viendo el contenido del contrato sería 0… bien por ISI.
Así que nada, esto seguirá dando vueltas hasta que, o bien ambos estemos de acuerdo con el contrato, o les mande a… y les pida que remuevan el circuito.
